NO. 8-3-167/K/1E, KALAYNA NAGAR, NEAR MOTI NAGARX ROADS, HYDERABAD, TELANGANA. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents, more particularly the Respondent No.3 in seeking to adjudicate the objection application dated 20.01.2024 filed by the Respondent No.4 vide notice bearing Rc.Spl/Objection/47 and 48/2023, dated 26.02.2024 without having any authority or jurisdiction whatsoever, and in withholding the compensation that the Petitioner is rightfully entitled to under the Right to Fair Compensation And Transparency In Land Acquisition Rehabilitation And Resettlement Act, 2013 and the preliminary notification dated 10.11.2022 bearing RC.No.A/G2/2458//2002 issued by the Respondent No.2 towards acquiring the 1/4 Petitioners lands admeasuring Ac.1.81 cents in Sy.No.846, and Ac.7.00 Cents in Sy.No.845 of Chevuru Village, Gudlur Mandal, Nellore District as being illegal, arbitrary, unlawful. against the principles of natural justice, without Jurisdiction highhanded and in direct contravention of the Right to Fair Compensation And Transparency In Land Acquisition Rehabilitation And Resettlement Act, 2013 and the fundamental rights guaranteed to the Petitioner under Articles 14, 21 and 300-A of the Constitution of India, and consequently set aside proceedings notice bearing the vide Rc.Spl/Objection/47 and 48/2023, dated 26.02.2024, initiated pursuant to the objection petition dated 20.01.2024 filed by the Respondent No.4, and direct the Respondent No.3 to Release the compensation amount that the Petitioner is entitled to under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation And Resettlement Act, 2013 and the dated 10.11.2022 bearing preliminary notification RC.NO.A/G2/2458//2002 issued by the Respondent No.2 towards acquiring the Petitioners lands admeasuring Ac.1.81 1/4 cents in Sy.No.846, and Ac.7.00 Cents in Sy.No.845 of Chevuru Village, Gudlur Mandal, Nellore District, and pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents, more particularly Respondent No.3 to stay all further proceedings in the enquiry proceedings initiated vide notice bearing Rc.Spl/Objection/47&48/2023, dated 26.02.2024 pursuant to the objection petition dated 20.01.2024 filed by the Respondent No.4, and pass IA NO: 2 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents, more particularly Respondent No.3 not to dispossess the Petitioner herein without releasing the compensation due to the Petitioner as per the Act No.30 of 2013, and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant leave to the Respondent No.3 in W.P.No.27665 of 2024 to file counter affidavit in the above Writ Petition Counsel for the Petitioner: 1.
