(2) According to petitioner, he was a co-sharer in a land, which was acquired for construction of highway by National Highways Authority of India. In this writ petition, petitioner claims that the amount determined as compensation should be paid to him alone. By means of this writ petition, petitioner has sought the following reliefs:
“I. issue a order or direction for setting aside the impugned order dated 12-01-2018 and 16-01-2018 (Annexure no. 3) so far as it relates to the land and buildings of the petitioner.
II. issue a writ, order or direction in the nature of mandamus directing the respondents to not to distribute the compensation of khata no.96 and of khatuni no. 3161 to the other share holders.
III. issue a writ, order or direction in the nature of mandamus directing the respondents to give the compensation of khata no.96 and of khatuni no. 3161 to petitioner as provided of The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for acquisition of land for the purpose of National Highway no. 58, in district- Chamoli.”

(3) Dispute raised by the petitioner is regarding apportionment of compensation, for which a remedy is available under Section 3H(4) of National Highways Act,
1956. Since the issue raised by the petitioner in this writ petition cannot be decided without recording evidence and without going into question of title, therefore, writ petition is disposed of with liberty to petitioner to approach the appropriate forum, as is available to him under law.
