whereby imposing the punishment of WITHHOLDING OF TWO ANNUAL INCREMENTS WITH CUMULATIVE EFFECT upon the Petitioner without furnishing the Enquiry Report before passing the punishment order, in contravention of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and the principles of natural justice, as illegal, irregular, irrational and amounts to non-discharge of legal obligation conferred on him/her under the provisions of Andhra Pradesh Civil Services (CCA) Rules, 1991 and offends Articles 14, 16 and 21 of the Constitution of India and consequently direct Respondent No. 2 to number and decide the said Service Appeal in accordance with law and pass orders in accordance with law and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased suspend the operation of the Proceedings in Rc.No.4374/A2/2025 dated 10.05.2026 passed by Respondent No. 3, pending disposal of the main Writ Petition and pass Counsel for the Petitioner:

ORDER:
The present Writ Petition is filed seeking expeditious disposal of the appeal dated 22.06.2026 filed by the petitioner, questioning the order of penalty imposed by the 3rd respondent. 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Services-III appearing for the respondents. 3. The petitioner has been imposed with the penalty of withholding of two annual increments with cumulative effect, pursuant to an enquiry conducted under the A.P. Civil Services (Classification, Control and Appeal) Rules, 1991. 4. The learned Assistant Government Pleader for Services-III would submit that the appeal filed by the petitioner would be considered by the 2nd respondent and appropriate orders would be passed thereon. 5. Considering the above submission, the Writ Petition is disposed of, directing the 2nd respondent to consider and dispose of the appeal filed by the petitioner, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.
