It appears that the application for anticipatory bail was dismissed as not pressed so far as the petitioner no. 1 is concerned. 2. Learned counsel appearing on behalf of the petitioners submits that the petitioner no. 2 has been falsely implicated in this case. The petitioner no. 2 was not named in the FIR and there is hardly any material to connect the petitioner with the case of murder. 3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He refers to the statement of a witness giving last seen together account, as recorded at page 17 of the case diary. He also refers to other statements of witnesses and the post-mortem report. He submits that orders of proclamation and attachment have been issued in respect of the present petitioner. A 2 coordinate Bench of this Court had earlier rejected the application for anticipatory bail of a similarly circumstanced co-accused. 4. Considering the above, the other incriminating materials available in the case diary and the fact that orders of proclamation and attachment have been issued against the present petitioner no. 2, I do not consider this to be a fit case to grant anticipatory bail to the petitioner no. 2. 5. Accordingly, the application for anticipatory bail is rejected. 6. The personal appearance of the Investigating Officer is noted and is dispensed with. (Jay Sengupta, J.)
