JUSTICE ANAND SHARMA Order 06/07/2026 1. Principal prayer of the petitioner in the instant writ petition is that one Revenue Suit No.85/1996 titled as State Vs. Narayan & Ors. is pending before Court of Sub-Divisional Officer, Chaksu, District-Jaipur, therefore, direction be issued to the Sub- Divisional Officer to decide the said suit expeditiously. 2. Learned counsel for the petitioner submits despite the fact that the suit is pending for last around 30 years, till date it has not been decided, which is causing grave prejudice and miscarriage of justice to the petitioner. 3. Learned counsel for the petitioner further submits that under these circumstances, concerned Sub-Divisional Officer be directed to dispose of the suit expeditiously, so that rights of the contesting parties can be adjudicated in accordance with law. 4. Although ordinarily, there can be no interference in such writ petition, where prayer is made to expedite the proceedings of lower Court, yet in the peculiar facts of the present case, where a suit is pending for last around 30 years and as per learned counsel for the petitioner, there is no stay on proceedings of the suit-in-question, this Court deems it just and proper to dispose of the present writ petition with direction to the Sub- [2026:RJ-JP:25163] (3 of 3) [CW-5438/2026] Divisional Officer, Chaksu, District-Jaipur, to decide Revenue Suit No.85/1996 expeditiously and preferably within a period of one year after affording proper opportunity of hearing to the parties and strictly in accordance with law. 5. Accordingly, the present petition stands disposed of. 6. It is made clear that this Court has not expressed any opinion on merits of this case. 7.
