GP FOR HOME The Court made the following ORDER: The Writ Petition has been filed for the following relief: “…to issue writ, order direction more particularly in the nature of writ of Mandamus declaring the action of the Respondent Nos.2 to 4 in not registering the FIR against the Respondent No. 7 and others mentioned in the complaint in spite of the petitioner's oral and written complaint and also complaints dated 01.12.2025 through registered post and further one in spite of lodging in spite of several requests and Personal approaches of the arbitrary, improper, and unconstitutional petitioner is illegal and against the procedure contemplated under the code of criminal procedure or BNSS,2023 and also contrary to Hon’ble Supreme Court guideline passed in Lalita Kumari Vs Government of Uttar Pradesh reported in (2014) 2 SCC 1 and to pass…” 2. Heard the learned counsel for Petitioner, Mr.S.Syam Sundhar, learned Special Public Prosecutor for A.C.B and learned Assistant Government Pleader for Home. 3. Ms. Maheswari Arika, learned counsel for the Petitioner, submits that the petitioner submitted a complaint dated 01.12.2025 to Respondent Nos.2 to 4 for registration of an F.I.R. against the Respondent No.7 and others and for conducting investigation. But the complaint was not considered by the respondent police. 4. Sri S.Syam Sundhar, learned Special Public Prosecutor for A.C.B Cases and Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, submits that an officer of respondent No.4 has conducted a preliminary enquiry and came to know that no material was cited by the petitioner to show that 3 respondent No.7 had collected any money from the parties in S.O.P. Thereafter, the respondent No.4 could not take any action on the complaint filed by the petitioner. 5. Be that as it may, the Petitioner has got alternative efficacious remedy under Section 190 read with 200 of ‘the Cr.P.C.,’ / Section 210 read with 223 of ‘the BNSS’ when the complaint is not considered by the Respondent Police. 6. Considering the facts and circumstances of the case, and recording the submissions of the learned counsels appearing on both sides, the Writ Petition is disposed of granting liberty to the Petitioner to approach the learned Jurisdictional Magistrate/Special Judge by way of filing a complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’ / Section 210 read with 223 of ‘the BNSS’. 7. On filing of such private complaint by the Petitioner before the learned Jurisdictional Magistrate/Special Judge, the learned Magistrate/Special Judge is directed to bestow attention to the same and deal with the complaint in accordance with law. 8. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
