JUSTICE BHUWAN GOYAL Order 06/07/2026 These suspension of sentence applications have been filed by the appellants alongwith the appeals. [2026:RJ-JP:25108-DB] (2 of 2) [SOSA-2260/2025] Counsel for the appellants has annexed the certificate under Rule 311 (3) of the Rajasthan High Court Rules to the effect that the sentence of life imprisonment has been awarded to the appellants under Section 302 read with Section 34 IPC and they are in custody. Counsel further submits that case rests on circumstantial evidence and there is contradictions in the statement of witnesses and the hearing of the appeals may take long time, hence, the sentence awarded to the appellants may be suspended during the pendency of the appeals and they be released on bail. Learned Addl. Govt. Advocate assisted by counsel for the complainant has opposed the application for suspension of sentence and submits that the dead body has been recovered at the instance of accused-Ajay Kumar and according to the CCTV footage, the deceased was seen going with the accused-applicants and on the next day his dead body was recovered. In the facts and circumstances of the present case and looking to the nature of the offence(s) against the appellant and considering the CCTV footage, We are not inclined to grant the indulgence to the appellants as prayed for.
