1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners seek bail in a case registered for the offences punishable under Sections 272, 273, 328, 307, 302, 34 and 120(B) of the Indian Penal Code as well as Sections 30(a), 30(c) and 37(b) of the Bihar Prohibition and Excise Act, 2016. 3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are in custody since 25.12.2025 and allegation is of recovery of 750 ml. of liquor alogn with Rs.48,735/- in cash and empty liquor bottles from the house-cum-shop of Ram Exbal Sah and half filled bottle of 375 ml. wiskey and 10 ml. in 180 ml. bottle of wiskey was recovered from the shop of Manoj and Anoj Rai. Learned counsel for the petitioners submits that petitioners were not arrested from the spot, as such, nothing was recovered from their conscious possession and even the alleged recovery is from a place which does not belong to the petitioners and petitioners have no concern or relation with Ram Exbal Sah, Manoj and Anoj Rai. It is further submitted that petitioners are not named in the FIR and came to be implicated at the stage of supervision. 5. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioners. 6.
Considering the submissions made by the learned counsel appearing on behalf of the petitioners, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending in connection with Saraiya (Jaitpur O.P.)
