20.04.2026 Item No.28 Ct. No.1 KS W.P.A. (P) 174 of 2026 Sri Samir Biswas Vs. The State of West Bengal & Ors. Mr. Subrata Ghosh ….. For the Petitioner Mr. Tapan Kumar Mukherjee, Sr. Adv. Mr. Pinaki Dhole …..For the State DICTATED BY SUJOY PAUL, CJ.: 1. Parties are represented through their respective learned counsels. 2. The singular grievance put forth by the petitioner is that a complaint was filed by the residents of a particular area, which was reduced in writing in the shape of F.I.R., however, despite registering the F.I.R., no further action has been taken. Thus, it is prayed that an open enquiry in the locality in question be made and culprits be punished. 3. In the opinion of this Court, the remedy is elsewhere. If F.I.R. is already registered and 2 no further action has been taken, petitioner has a remedy under the B.N.S.S. Petitioner has not impleaded the persons eo nomine against whom, action is prayed for. 4. For these cumulative reasons, petition cannot be entertained and it is, accordingly, disposed of by reserving liberty to the petitioner to avail appropriate remedy. 5. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities. (SUJOY PAUL, CJ.) (CHAITALI CHATTERJEE (DAS), J.)
