Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there is no other material available against the petitioner. Charge sheet has been submitted. 3. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that other than the statement of the co-accused, there is a criminal antecedent of the petitioner under the provisions of the NDPS Act. 4. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner. 2 5.
