The instant bail application is moved on behalf of the present applicant-Simran Singh, S/o Gurucharan Singh for seeking regular bail in reference to first information report dated 05.07.2026 bearing FIR No.0187 of 2026, P.S. Khatima, District Udham Singh Nagar for the offences punishable under Sections 109(1), 351(3), 352, 3(5), 61(2) of BNS and Section 3/25 of Arms Act, which was lodged against one unknown person and now during investigation the name of the applicant was disclosed, consequently he is also implicated though the investigation is still going on. 4. Learned counsel for the applicant submits that applicant have no criminal antecedents and it is a case of no injury and only on the basis of CCTV footages applicant has been implicated and since he was seen to be standing at the place of alleged occurrence though no role has been assigned to him. He submits that one Baljeet Singh, co-accused, is already granted interim protection by the Coordinate Bench in WPCRL No.1297 of 2026 and another co-accused Harpreet Singh is also granted similar protection by the Coordinate Bench in WPCRL No.1315 of 2026 and one more co-accused Kulwant Singh was granted anticipatory bail by learned Additional Session Judge, Khatima by order dated 29.07.2026. 5. It is submitted by learned counsel for the applicant that since it is a case of no injury and the applicant have no criminal antecedents and the other co-accused have been granted interim protection by this Court and another co-accused granted anticipatory bail by the trial court, therefore, applicant, who is languishing in jail since 09.07.2026 be enlarged on bail. 6. On the other side, Mr. Tumul Nainwal, learned AGA have not disputed that some of the co-accused have been granted interim protection by the Coordinate Bench in Criminal Writ Petitions and one co-accused is also granted anticipatory bail by the trial court and the present applicant as per the statement, as given on affidavit, have no criminal antecedents, can be given the benefit of other co-accused by putting some rider so that he may cooperate with the ongoing investigation. 7. After hearing the submissions of learned counsel for the parties and taking into consideration that two other co-accused have been granted interim protection by this Court and one another co-accused is also granted anticipatory bail by the trial court and it is a case of no injury and the applicant is not named in the FIR, this Court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the present applicant-Simran Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 10.
