04/22.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Deoghar Town P.S. Case No.398 of 2025, registered for the offence under Section 303(2) of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Deoghar.

Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. He further submits that two persons, namely, Kuldip Raut and Ranjit Raut have been apprehended and they have taken the name of the petitioner by saying that the petitioner is having brass utensil shop and stolen article has been sold in the shop of the petitioner. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 12 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of selling of stolen article in the shop of the petitioner.
5. Considering that the name of the petitioner is not disclosed in the FIR and it further transpires that the petitioner is having shop of brass utensil and

he has got no criminal antecedent, as disclosed in paragraph 12 of this application and the name of the petitioner has come on confessional statement of the apprehended co-accused and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Deoghar in connection with Deoghar Town P.S. Case No.398 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
