Learned counsel, Mr. D. Dey is present for the applicant. M/s. Assam Trade and Agencies, who has filed this application u/s 5 of Limitation Act, 1963 for condonation of delay of 15 days in filing the connected criminal appeal against acquittal. Learned Amicus Curiae, Mr. Darak Ullah is present for the respondent no.2 and Mr. P.S. Laskar, learned Additional Public Prosecutor for the State is present. It is submitted that as the petitioner was busy with his business, he could not come to affix his signature on the affidavit in the Month of March. This resulted in the delay. Sufficient grounds have been shown. It appears that delay may be condoned. Thereby, the delay of 15 days is condoned. Registry to register the connected appeal.
