At the outset, learned counsel, Mr. Sentiyanger appearing for the respondent No. 2 has objected to the maintainability of the present petition as the prayer portion is defective and the petitioner has not assailed the judgment and sentence of the learned Chief Judicial Magistrate, which was the original court and has only assailed the judgment and order dated 25.04.2025 in the appeal before the learned Sessions Judge, Mokokchung. Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file afresh. Page No.# 3/3 Prayer is allowed.
