ORAL ORDER
1. Proceedings have been initiated against the petitioners by the Greater Bengaluru Authority(GBA) and the Bangalore Electricity Supply Company (BESCOM) for putting up construction in violation of the building bye-laws and the sanctioned plan in respect of the property which is the subject matter of the writ petition.
2. The case of the petitioners is that though the construction put up is in violation of the sanctioned plan, but it is not in violation of the building bye-laws, and the same can be regularized and that the petitioners have submitted a modified plan in this regard.

Learned counsel appearing for respondent nos.1 and 2 (GBA), upon instructions, submits that the matter is pending for consideration before the second respondent - the Joint Commissioner and he further submits any action to be initiated against the petitioners will be done after a decision is taken by the Joint Commissioner, and not otherwise who shall also

decide as to the request for regularisation of construction. Hence, the following:-
ORDER i. The writ petition is hereby disposed of with a direction to respondent Nos.1 and 2 (GBA) and respondent No.3 (BESCOM) not to take any coercive steps against the petitioners till an appropriate order is passed by respondent no.2 - Joint Commissioner, GBA in this regard.
