02/ 27.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 103(1) of the BNS.
2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order.
3. Learned AddI. P.P. opposes the prayer for bail.
4. Petitioner is none but the son of the deceased. The deceased was heavily drunk and while returning his son i.e. the petitioner helped him, but the deceased started abusing and assaulting him. He pushed the deceased, as a result of which the deceased fell and his head struck with the stone and thereafter it is stated that this petitioner also assaulted him resulting in his death.
5. Considering the fact, Prima facie, I am of the opinion that there was no intention to commit murder, thus, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Gumla in connection with S.T. Case No.216 of 2025, arising out of Kamdara P.S. Case No.44 of 2025 (G.R. Case No.529 of 2025) subject to the condition
that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand.
