Petitioner has filed this petition seeking following relief (s) :- “10.1 That the Hon’ble Court may kindly be pleased to call the records pertaining to the case of the petitioner. BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 10.2 That the Hon’ble Court may kindly be pleased to issue an appropriate writ, order or direction directing the respondents to provide suitable alternative posting in regular Government schools to the petitioner who has declined consent for deputation to Swami Atmanand Excellence Schools. 10.3 That the Hon’ble Court may kindly be pleased to issue an appropriate writ, order or direction directing the respondents to consider and give due effect to the recorded non-consent of the petitioner (s) for deputation, and to take a consequential decision within a time bound period. 10.4 That this Hon’ble Court may kindly be pleased to pass such other order (s) or direction (s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner is working as Peon with school run under State Government, however, pursuant to policy decision taken by the State Government, school in which petitioner was working has been upgraded in Swatmi Atmanand Hindi Medium School. According to policy formulated by State Government employees of the State are to be posted in the Swami Atmanand School only on the basis of deputation. Petitioner has not been asked to give consent and no order for posting of petitioner on deputation is passed. He submits that as in case of Prakash Rao Maratha Vs. State of Chhattisgarh in WPS No. 477 of 2026 decided on 16.01.2026, the writ petition is disposed of permitting petitioner to submit representation, therefore, petitioner may also be permitted to submit representation to be considered and decided by the respondents authorities. 3 3. Learned State counsel submits that he is having no objection to the limited prayer made by learned counsel for petitioner. She however, submits that in case of Prakash Rao Maratha (supra), petitioner therein was Lecturer (Maths) and petitioner in the case at hand is working as Peon. 4. On due consideration on the submission of learned counsel for parties and in view of the limited prayer made by learned counsel for petitioner, this writ petition is disposed of permitting petitioner to submit representation before the respondent No.3 and 4 and in the event petitioner submits such representation, the concerned authority shall consider and decide the same in accordance with law expeditiously preferably within further period of two months from the date of receipt of representation. 5.
