Also heard Mr. K Konwar, learned counsel for the contemnor No. 1. 2. By way of this interlocutory application, the applicant seeks impleadment of the Commissioner & Secretary to the Government of Assam, Finance Department, as contemnor/opposite party No. 3 in the connected contempt petition, i.e., Cont. Cas. (C) No. 413/2024. 3. The aforesaid contempt petition has been filed alleging non-compliance of the order dated 09.04.2024 passed by this Court in WP(C) No. 627/2024. 4. During the pendency of the connected contempt proceeding, it has been brought to the notice of this Court, by a letter dated 21.11.2025, that the Page No.# 3/4 Commissioner, Panchayat & Rural Development Department, Assam, had stated that the Government in the Panchayat & Rural Development Department had forwarded a proposal for grant of pensionary benefits to 423 persons, including the petitioner’s husband. However, the Finance Department regretted the proposal for grant of pension and pensionary benefits to the aforesaid provincialised Panchayat employees who had retired from service on or after 01.10.1991 after rendering more than 10 years but less than 20 years of qualifying service. 5. It is the further case of the petitioner that, despite this Court having disposed of the writ petition in her favour, the judgment and order passed therein have not been complied with till date. 6. In view of the aforesaid development, it is contended that the presence of the Finance Department is essential for the effective adjudication of the connected contempt proceeding, and accordingly, the present impleadment application has been filed. 7. Mr. K. Konwar, learned counsel appearing for contemnor No. 1, does not oppose the prayer for impleadment. 8. Having considered the submissions advanced on behalf of the parties and upon perusal of the materials available on record, this Court is of the view that the presence of the Commissioner & Secretary to the Government of Assam, Finance Department, is necessary for the effective adjudication of the connected contempt proceeding. 9. Accordingly, the Commissioner & Secretary to the Government of Assam, Finance Department, is impleaded as contemnor/opposite party No. 3 in the connected contempt proceeding. Page No.# 4/4 10. Let an amended cause title be filed before the Registry for doing the needful. 11. With the above observations and directions, the instant interlocutory application stands allowed and disposed of.
