JUSTICE PARTHA SARTHY ORAL ORDER 2 15-04-2026 The petitioner has filed the instant application for the following relief :- “a) To Issue an appropriate writ, order or direction, including a writ in the nature of Certiorari, for quashing the impugned requisition dated NIL (Annexure P/1) which was not given to the Pramukh but was routed through Executive officer cum BDO whereby vague charges have been made against the petitioner in violation of the mandatory provisions of the Bihar Panchayat Raj Act, 2006; b) To Issue an appropriate writ, order or direction, including a writ in the nature of Certiorari, for quashing the impugned letter no 321 dated 30/03/2026(Annexure P/2) whereby the said letter has been issued by the Executive officer without mentioning charges on it in complete violation of the mandatory provisions of the Bihar Panchayat Raj Act, 2006 Patna High Court CWJC No.5021 of 2026(2) dt.15-04-2026 3/3 c) To Issue an appropriate writ, order or direction, including a writ in the nature of Mandamus, restraining the respondents from giving effect to the impugned requisition; d) To Issue an appropriate writ, order or direction, including a writ in the nature of Mandamus directing the BDO cum Executive officer to strictly follow the judicial guidelines laid down by Honourable Supreme court for No Confidence motions brought against the Pramukh/elected representatives in Bihar in SLP (Diary No) 2168/2025. e) Issue any other writ, order or direction as this Hon’ble Court may deem fit and proper in the interest of justice;” 2.
