(2) According to petitioner, his house, in which he was residing and also running a hotel, was demolished during widening of All-Weather Road Project on NH-94/134. The said house was allegedly situate at Kharadi, Barkot, District Uttarkashi. Grievance raised by the petitioner is regarding non-payment of compensation for demolition of his house. (3) Learned State Counsel, however, submits that the land over which house was constructed was government land. Learned Counsel for the petitioner submits that petitioner’s possession over the said land was more than 12 years old, therefore, as per government policy contained in Government Order dated 22.7.2019, he is entitled for compensation. (4) Learned State Counsel submits UKHC010145282026 2026:UHC:7639 that petitioner was required to submit certain documents to prove that his possession is more than 12 years old; since petitioner failed to submit any document in support of his claim for possession, therefore, compensation cannot be paid to him. (5) Learned Counsel for the petitioner submits that petitioner will furnish all necessary documents in support of his claim for possession to the Executive Officer, National Highway Division, Uttarakhand Public Works Department within two weeks, who may be directed to examine petitioner’s claim, as per law. (6) Writ petition is, accordingly, disposed of with liberty to petitioner to submit all documents, which are needed for award of compensation under the government policy. If he submits all necessary documents and makes a formal request for paying compensation to him, the competent authority shall examine his claim and pass appropriate order, in terms of condition no. 2 of aforesaid government order, within four months thereafter.
