By filing this writ petition, the petitioner has prayed for the following reliefs:- “This writ petition has been filed by the petitioner for issuance of an appropriate writ(s), order(s) or direction(s) particularly a writ in the nature of Certiorari for quashing of the order dated 13.11.2025 passed in Misc. Appeal Case No. 11/2025 by the respondent no.2(Annexure-8) by which previous decision taken by the petitioner have been stayed with direction to the petitioner not to violate the previous judgment till then a Committee can be formed to take day to day financial decision by board and meeting can be convened by chairman of the society. And/Or ( 2026:JHHC:11801 ) 2 Petitioner further prays for quashing of the decision taken in Proceeding No. 3 of Board of Director’s meeting dated 20.11.2025 issued vide Memo No. 96 dated 21.11.2025 (Annexure-9) which is in consequence to the Order dated 13.11.2025 passed in Misc. Appeal Case No. 11/2025 by Respondent no.2. And/Or Petitioner further prays that during pendency of the instant writ petition, Operation, implementation and execution of Order dated 13.11.2025 (Annexure-8) passed in Misc. Appeal Case No. 11/2025 by Respondent No. 2 and decision taken in Proceeding No. 3 issued vide Memo No. 96 dated 21.11.2025 (Annexure-9) may kindly be stayed. 3. During the course of argument, learned counsel representing the petitioner submits that appeal being Misc. Appeal Case No.11/2025 is still pending before respondent No.2. 4. Considering the dispute involved in this writ petition, where the petitioner is claiming to be the Secretary, and the respondent is opposing his election and the matter is pending before the Appellate Authority, I direct the Appellate Authority i.e. respondent No.2, to dispose the appeal after hearing all the parties concern, preferably within a period of six months from the date of receipt of copy of this order. 5. The petitioner will produce a copy of this order before respondent No.2 who will take an appropriate action. 6. With the aforesaid direction, this writ petition stands disposed of.
