1. Heard Mr. S.H. Sikdar, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. 2. This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioners, namely, (i) Jahar Ali (ii) Feddus Ali Ahmed (iii) Aman Ali (iv) Mokibul Islam (v) Moidul Islam (vi) Sadek Ali, have prayed for granting pre-arrest bail, apprehending arrest in connection with Boko P.S.
case
No.
402/2025 under
Sections 126(2)/191(3)/117(2)/118(2) of BNS, 2023. 3. The allegation is that there is some property dispute between the parties for which a civil case is pending before the learned civil
Page No.# 3/3 court. In the ejahar, it is alleged that the accused petitioners assaulted the informant side caused injuries. 4. The learned Additional Public Prosecutor submits that charge-sheet has already been submitted vide Charge-sheet No.4/2026 dated 20.01.2026. 5. Having regard to the fact that the investigation is over and the nature of the allegations, the custodial detention of the petitioners may not be necessary. 6. The order of pre-arrest bail dated 09.01.2026 is hereby made absolute subject to the conditions : i) That the petitioners shall regularly participate in the trial, if on commences ; ii) That the petitioners shall not try to influence or intimidate the witnesses in any manner; iii) That the petitioners shall not hamper or tamper with evidence. 6.
