Affidavit-of-service filed by the petitioner is taken on record. Learned advocate for the petitioner submits that the petitioner is in custody since 09.12.2025. It has been contended that the principal accused being a juvenile has been granted bail by the JJB and the another accused namely Rakesh Sk has been granted bail on 19.07.2025 by the learned Special Court. Additionally, it has been submitted that the petitioner surrendered after his anticipatory bail was rejected on 5th December, 2025. 2 I have taken into account the statement of the victim under Section 183 of the BNSS. Prima facie, I find that the present petitioner and Rakesh Sk - who has been granted bail, are on the same footing. Having considered the same, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Rubel Sk @ Rubel Sekh shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special (POCSO) Court, Murshidabad at Berhampore. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court and shall not leave the district of Murshidabad without prior intimation to the learned Special court. Accordingly, CRM (M) 714 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
