(2) Petitioner’s husband, who was employed as a Group D employee in Union Bank of India, died within four months of his marriage. Learned Counsel for the petitioner points out that the marriage between petitioner and her husband was solemnised on 14.4.2024, while death of her husband occurred on 15.8.2024. Petitioner applied for compassionate appointment, however her request is not being considered only on the ground that she has not produced any certificate to indicate that she is the legal heir. By means of this writ petition, petitioner has sought the following reliefs: “1. Issue a writ order or direction in the nature of Mandamus commanding and directing the respondents to consider the candidature of the petitioner for compassionate appointment as dependent (Spouse) of Late Govind Raj. 2. Issue a writ order or direction in the nature of mandamus commanding and directing the respondent to consider the representation UKHC010139882026 2026:UHC:7566 dated 10.7.2026 of the petitioner (annexed as Annexure No. 10 to this writ petition, from page no. 36 to page no. 37 of this writ petition) with giving opportunity of hearing for petitioner for consideration in terms of Modified Scheme, 2025 (annexed as Annexure No. 11 to this writ petition, from page 38 to page 44 of this writ petition).” (3) Learned Counsel for the petitioner submits that petitioner’s mother-in-law and father-in-law have given No Objection Certificate in favour of petitioner, regarding compassionate appointment; petitioner has survivorship certificate, issued by SDM, Haridwar, which shows that she is legally wedded wife of Govind Raj; she also has ration card, in which she is shown as wife of Govind Raj. He further submits that in the death certificate of Govind Raj also, petitioner’s name is mentioned as wife of deceased. He further submits that a child was also born to the petitioner on 21.12.2024 and in the birth certificate also, name of deceased is mentioned as father of the child. Thus it is contended that there is sufficient evidence available with petitioner to prove her relationship with Govind Raj, yet bank authorities are unnecessarily harassing the petitioner. (4) Since there is no rival claim made by anyone in the family of petitioner’s husband, including her brother-in-law or sister-in-law, and petitioner’s case is covered as per the policy applicable in the bank regarding compassionate appointment and only objection raised by the bank is regarding legal heir certificate, therefore, doubt raised by bank authorities on petitioner’s eligibility for compassionate appointment appears to be unfounded. Writ petition is, accordingly, disposed of with a UKHC010139882026 2026:UHC:7566 direction to the competent authority in the bank to consider petitioner’s claim for compassionate appointment, based on the documents available with her, and pass appropriate order, granting compassionate appointment to her, within two months from the date of presentation of certified copy of this order.
