Learned advocate for appearing for the petitioner submits that the petitioner is in custody for more than 11 months and till date charges have been framed, as such, further detention of the present petitioner is unwarranted. Learned advocate for the State opposes the prayer for bail and submits that there was recovery of iron rod pursuant to leading statement of the present petitioner. Prosecution has relied upon 12 witnesses in order to prove its case. I have considered the issue of initial dispute between the petitioner and his associates as well as the family members of the deceased, the genesis of which relate to water supply and water connection. Having regard to the same, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.
2 Accordingly, petitioner namely, Kamalesh Das shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall make himself available on on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without prior permission of the learned trial Court. Thus, CRM (M) 746 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
