In this petition, the petitioner is seeking the initiation of contempt proceedings against the willful disobedience and non-compliance of the judgment dated 22nd December, 2024 passed by this Court in WP(C) No. 1812/2022 titled “Union Territory of J&K and Ors vs. Showkat Ahmad War and Ors”. 2. On being put to notice, the respondents have filed their compliance report and have also placed on record copy of the Govt Order No. 08-JK (Rev) of 2026, dated: 30th March, 2026, whereby the grievance of the petitioners in terms of judgment passed by this Court has been considered by the Competent Authority and the claim of the petitioners for regular absorption in the Government Service has been rejected on the ground that in absence of any policy for absorbing or regularizing the employees like the petitioners, it is not possible to pass any regularization order in favour of the petitioners. 3. In view of the aforesaid, there remains nothing to be complied with. The judgment passed by this Court is implemented in letter and spirit. 4. This petition is accordingly dismissed. 5. We, however, leave it open to the petitioners to call in question the consideration order on all available grounds and including that the consideration by the Competent Authority to their plea for regularization has not been in accordance with the law. 6. We are informed that the Govt Order No. 08-JK (Rev) of 2026, dated: 30th March, 2026 (supra) has already been challenged by the petitioners in WP(C) No. 751/2026 only to the extent of disengagement. 7. In that view of the matter, it is up to the petitioners to either amend the petition and challenge the order afresh or file a fresh petition after withdrawing the aforesaid petition. 8. We leave it to the petitioner to take a view in the matter. 9. We further clarify that we have not expressed any opinion on the maintainability of the writ petitioner already filed by the petitioner to challenge the Government Order dated 30.03.2026.
