This bail application has been filed under Sections 483 and 484 of the Bhartiya Nagarik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offence punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner, learned counsel for the State and also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. From the admitted facts it is apparent that the dispute arose in respect of transportation of the sand and thereafter, scuffle took place and in the said scuffle, the petitioner pushed the mother of the informant who fell down and sustain grievous injury and later on died. 5. Considering the nature of allegation, I am of the opinion that prima-facie this is not a case of murder, thus, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Dumka in connection with 2026:JHHC:6394 2 Raneshwar P.S. Case no. 36 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner having sufficient landed property in his/her own name within the State of Jharkhand.
