PATTANAIK Order No. ORDER 22.04.2026 01. 1. Both the ABLAPLs are taken up together and disposed of by the following common order. 2. Heard learned counsel for the petitioners and State. 3. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Talcher P.S. Case No.1193 of 2025 corresponding to G.R. Case No.2142 of 2025 pending in the file of learned S.D.J.M., Talcher on the grounds stated. 4. Perused the FIR as at Annexure-1. Recorded the submissions of learned counsel for the respective parties. In course of hearing, an order dated 10th December, 2025 in BA No.655 of 2025 of the learned Additional Sessions, Judge Talcher is produced to submit that the petitioners should also be allowed to go on bail extending parity which is, however, seriously objected to by Mrs. Mohanty, learned ASC for the State on the ground that the petitioners do have criminal antecedents. Considering the nature of allegations revealed from the FIR, the Court is not inclined to entertain the bail plea of the petitioners, however, is in favour of directing them to surrender before the learned court below seeking regular bail pleading parity. 5. Accordingly, it is ordered. 6. In the result, both the ABLAPLs are disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender within a fortnight from today before learned S.D.J.M., Talcher in connection with Talcher P.S. Case No.1193 of 2025 corresponding to G.R. Case No.2142 of 2025 and move regular bail, it shall be duly considered and in case rejected during the first hour, they shall approach the learned Sessions Court during the second hour for orders on the same day and for the said purpose, lower court record shall be made available. It is further directed that the learned courts below shall consider the plea of parity of the petitioners, while dealing with the applications for bail. 7.
