Learned advocate appearing for the petitioner submits that petitioner is in custody for 5 months and other accused persons have been granted bail. Charge sheet has already been submitted before the jurisdictional Court, as such there is no necessity for the petitioner languishing in jail.
Learned advocate for the defacto complainant is present and opposes the prayer for bail.

Learned advocate for the State has produced the case diary, drawn the attention of the Court to the statement of the victim under Section 164 of the Cr.P.C. as well as the Medico Legal Examination Report.
Having considered that charges are yet to be framed and the victim is to be examined, I am not inclined to release the petitioner on bail at this stage.
If required, petitioner will approach this Court after the evidence of the victim is over.
Consequently, CRM (M) 721 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
