(Oral) This application under Section 528 of the BNSS, 2023, has been filed by the applicant, who is informant-victim in the case, for expediting the Criminal Case No.348 of 2023 (Old Criminal Case No.770 of 2019) State Vs. Vimlawati and Others, under Sections 419, 420, 467, 468, 471 and 120-B IPC, pending before the Court of learned Judicial Magistrate, Mussoorie, District Dehradun. 2. It is informed by learned counsel for applicant that proceedings of the aforesaid criminal case were stayed by the Coordinate Bench of this Court in C482 No.1540 of 2023 Smt. Bimlawati Vs. State of Uttarakhand and Others, and the said C482 application was withdrawn by Smt. Bimlawati-applicant of that C482 application, on 06.03.2024, when the stay order has been vacated. 3. It is contended by learned counsel for applicant that at present, only charges have been framed against the accused persons and not a single prosecution witness has been examined. In such view of the matter, this Court is of the view that it is too early to direct the learned Trial Court to expedite the proceedings of the aforesaid criminal case. Accordingly, the present C528 application is dismissed in- limine at this stage.
