3. Present applicant-Puran Singh Rana, who is 72 years old, is facing trial for the offences punishable under Section 5/6, 7/8 of the POCSO Act arising out of first information report dated 02.08.2025 bearing FIR No.0148 of 2025, P.S. Dineshpur, District Udham Singh Nagar is seeking regular bail.

Learned counsel for the applicant submits that the present applicant is innocent and the prosecution story is highly unbelievable because of the age of the present applicant, at the time of incident as he was 70 years old. Apart from this, he submits that the charge sheet has already been filed and the present applicant is languishing in jail since last more than one year i.e. w.e.f 03.08.2025 and there is no substantial progress in the trial.
5. On the other side, Mrs. Rangoli Purohit, learned AGA submits that after collecting all the credible evidence charge sheet has been filed including certain video
clips which has been sent for the FSL and the report is still awaited though charge sheet has already been filed and also not disputed the age of the present applicant, who at the time of incident was 70 years old.
6. After hearing the submissions of
learned counsel for the parties and taking into consideration the age of the present applicant, who, at present, is now 72 years old and the charge sheet has already been filed and he has suffered incarceration of more than one year as he is languishing in jail since 03.08.2025 and there is no substantial progress in the trial, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the instant second bail application is allowed.
8. Let the present applicant-Puran Singh Rana be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned subject to the following conditions:
“i. Applicant shall join the trial court proceeding on each and every date without seeking any unnecessary adjournment. ii. The applicant shall not indulge in any criminal activities and will not make any attempt to temper with the evidence.
In breach of any conditions as aforesaid, the prosecution is free to move an application for cancellation of bail.
