(ii) That, the Hon'ble Court please to quash the impugned suspension order dated 24.11.2008 and passed the order to be continued the service of petitioner father Dheeraj Prasad Suryavanshi. (iii) That, the Hon'ble Court may kindly please to issue the order, direction to the respondents to be release thesuspension allowance to the petitioner from the date of suspension order. (iv) Any other appropriate relief may also be granted in case as may deem fit by the Hon'ble Court as per the facts and circumstances of the case, 2) Learned counsel appearing for the petitioner submits that initially petitioner’s father was appointed to the post of Chowkidar under respondent department vide order dated 30.5.1992 and his services were transferred to various places during the service tenure and at the relevant time he was posted at Kritrim Garbhdharan Kendra, Mungeli. He further submits that petitioner’s father remained absent from service and on the basis of a complaint, he was placed under suspension vide order dated 24.11.2008 and he has not been paid salary/subsistence allowance since 2008. He contends that mental status of petitioner’s father is not sound and sufficient medical documents have been placed to substantiate the same.
He further contends that according to circular dated 1.10.2005 issued by the State Government, mentally and physically retarded persons are entitled for all benefits and their services cannot be terminated on account of their disability. He argues that petitioner may be
3 permitted to make representation before respondent No. 3 and the said authority may be directed the decide such representation expeditiously. 3) On the other hand, learned State counsel submits that petitioner’s father did not approach the respondent authorities along with relevant documents therefore salary has not been paid to him. He further submits that petitioner’s father remained absent without any authorization therefore he is not entitled for salary or other benefits. He contends that this petition petition is misconceived and deserves to be dismissed. 4) I have heard the learned counsel appearing for the parties and perused the documents placed on record. 5) Relevant paragraph of the circular dated 1.10.2005 reads as under :-

विकय गय सशा)धान क आधारा पुरा जोरा विकय गय हK। 6) Perusal of medical documents annexed to the writ petition would show that mental status of petitioner’s father is not sound but at the same time sight cannot be lost to the fact that he remained absent from the duties unauthorizedly and salary for that period has not been paid to him. 7) Taking into consideration the above-discussed facts, this petition is hereby being disposed reserving liberty in favour of the petitioner to make a representation before the Deputy Director, Pashu Chikitsa Services, Korba i.e. respondent No.3 in light of circular dated 1.10.2005 within period of 30 days from today. It is expected that the authority concerned shall consider and decide such representation, if so preferred by the petitioner within period of 90 days from the date of receipt of copy of the same. 8) With the aforesaid direction, this petition stands disposed.
