This application has been filed under Section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the petitioner namely, Alakesh Nath, who is stated to have been in custody since 21.05.2026, has prayed for bail in connection with Nagaon P.S Case No. 365/2026 under Section 108 of BNS, 2023. 3. The allegation against the petitioner is that the petitioner is responsible for the suicidal death of a 15 year old student. 4. Case diary is received. 5. It is submitted that charge-sheet has not yet been laid. The petitioner has been behind the bars for 58 days. 6. The learned Additional Public Prosecutor has raised objection stating that there are incriminating materials in the case diary against the petitioner. 7. I have scrutinized the case diary. It reveals that there are incriminating materials against the petitioner. However, considering the length of his detention and the progress of the investigation, it appears that the petitioner may be granted bail. 8. Considering the entire aspect of the matter, the above-named petitioner is allowed to go on bail of Rs.50,000/- (Rupees Fifty Page No.# 3/3 Thousand) only with one surety of like amount subject to the satisfaction of the learned Elaka Magistrate/Jurisdictional Court. 9.
