The applicant has preferred this 3rd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 596/2024, registered at Police Station – Telibandha, Raipur, District- Raipur (C.G.) for offence punishable under Sections 109, 103 of BNS and Sections 25 & 27 of the Arms Act. 2. First bail application of the applicant was dismissed on merits vide order dated 23.06.2025 passed in MCRC No.4214/2025. Second bail application of the applicant was also dismissed on merits vide order dated 10.09.2025 passed in MCRC No.7228/2025 and it was ordered Digitally signed by RAVVA UTTEJ KUMAR RAJU 2 to expedite the Trial as expeditiously as possible preferably within period of 5 months. However, despite direction of this Court, the Trial was not concluded, therefore, information was sought from the concerned trial Court vide order dated 20.04.2026. In compliance of the same order, request letter dated 25.04.2026 was received from the concerned Trial Court in which it seeks extension of time limit for conclusion of the trial. 3. The prosecution story in brief is that the complainant Dhaneshwari Yadav lodged a report stating that on 16.09.2024 at about 4.00 p.m., at the basement of Momo Magic Cafe, in front of Marine Drive, Raipur, the present applicant Jugru Tarak attacked the victim Yogita Sahu with a sharp edged weapon on her neck and caused fatal injury with the intention of killing her. When the complainant came to the rescue of victim, the present applicant also grabbed her neck and pushed her and then he fled from the scene. Thereafter, the victim was admitted in the hospital where she died during treatment. Based upon such report and memorandum statement, offence has been registered and the applicant has been arrested. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The case of prosecution solely based upon circumstantial evidence. Dhaneshwari Yadav (PW-3) and Kishan (PW-7) has not supported the case of prosecution and turned hostile. The applicant has been in jail since 18.09.2024. Out of a total of 24 prosecution witnesses, only 10 have been examined till date, and the trial is likely to take some time to conclude. Therefore, it is prayed that the applicant may be enlarged on bail. 5. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that there was seizure blood stained knife from the applicant and there is material evidence available on record against him. Therefore, considering the nature and gravity of the offence, the applicant may not be released on bail. 6. I have heard learned Counsel appearing for the parties and perused the material available on record. 3 7. Considering the facts and circumstances of the case and evidence collected by the prosecution against the applicant without commenting on merits of the case, I am not inclined to release the applicant on bail. 8. Accordingly, the bail application is rejected. 9. On the basis of request letter sent by the learned trial Court seeking extension of time for conclusion of trial, 04 months time is hereby extended to conclude the trial.
