Mr. Gaurav Singh, learned counsel for the applicant. 2. Mr. Vijay Khanduri, learned Brief Holder for the State. 3. The instant bail application is moved on behalf of the applicant Firdos, W/o Usman who is facing the trial for the offences punishable under Sections 3/5/11 of the Uttarakhand Protection of Cow Progeny Act, 2007, P.S. Bhagwanpur District Haridwar, arising out of FIR dated 28.03.2026 bearing FIR/Case Crime No. 140 of 2026. 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and there is no recovery from the present applicant and the recovery which is shown is from the other co-accused who has already been enlarged on bail by the Coordinate Bench on 20.04.2026. He further submits that the present applicant is languishing in jail since 04.06.2026 and she has no criminal antecedent and furthermore she is a married woman, therefore, she also deserves privilege in terms of Section 480 of BNSS 2023 and now the charge sheet has been filed. 5. On the other side, Mr. Vijay Khanduri, learned Brief Holder for the State have not disputed that charge sheet has already been filed and present applicant has no criminal UKHC010115202026 2026:UHC:7272 antecedent and other co-accused has already been enlarged on bail by the Coordinate Bench. 6. After hearing the arguments of the learned counsel for the parties and taking into consideration that charge sheet has already been filed and the applicant has no criminal antecedent and other co-accused has been granted bail by the Coordinate Bench, this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant Firdos, W/o Usman be released on bail on her executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 9. It is made clear that after being released on bail the applicant shall join trial court proceeding and will not seek unnecessary adjournment. (Rakesh Thapliyal, J.) 14.08.2026 Parul
