2026:JHHC:6881 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 1849 of 2026 --------- Manish Kumar Khirwal @ Manish Khirwal, aged about 31 years, son of Basant Kumar Khirwal, resident of Madhu Bazar, Chaibasa, P.O. & P.S. Sadar, District West Singhbhum, Jharkhand. ....Petitioner Versus The State of Jharkhand ....Opp. Party --------- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN --------- For the Petitioner : Mr. Deepak Kumar, Advocate For the Opp. Party : Mr. Vineet Kr. Vashistha, A.P.P. --------- 02/13.03.2026 Heard learned counsels for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Sadar P.S. Case No. 87/2025, registered for the offences under Sections 17(a), 21(a) and 29 of the NDPS Act, 1985, pending in the Court of learned Sessions Judge, West Singhbhum at Chaibasa. 3. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that the recovery was allegedly made at a Public Railway Underpass Cabin at 08:50 P.M., yet no independent witnesses were joined. There is no independent eye witness to the seizure list rather, the same has been prepared in presence of the police personnels. He further submits that petitioner is languishing in custody since 10.11.2025; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court. 4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that after his arrest, the petitioner has made confessional statement before the police in which he has admitted his involvement in illegal sale and purchase of brown sugar. 5. Looking to the gravity of charges, I am not inclined to enlarge the petitioner on bail at this stage. However, he may renew his prayer for bail after two months. 6. Accordingly, the instant application stands dismissed. (Deepak Roshan, J.) 13th March, 2026 kunal/- Uploaded on 17.03.2026
