The challenge in this appeal is made to the order dated 08.03.2021, passed in Original Suit No.279 of 2017, Ramesh Chand Gera and Others v. Smt. Basant Kaur and others (“the suit”), by the court of IX Additional Civil Judge (Senior Division), Dehradun. Heard learned counsel for the parties and perused the record. Learned counsel for the respondent no.1 submits that the suit has already been dismissed in default on 02.11.2023, and restoration application is pending. Learned counsel for the appellants submits that he has sought instructions from the appellants, but they are yet to be received. But, according to him, if the learned counsel for the respondent no.1 has the information, based on it, action may be taken. In fact, learned counsel for the respondent no.1 has placed for the perusal of the Court the record with regard to the case history, which reveals that, in fact, the suit has been dismissed on 02.11.2023. The record that has been tendered for the perusal of the Court be taken on record. Since the suit itself has been dismissed, nothing survives in this appeal. It stands disposed of, accordingly.
