Heard learned counsel for the parties. 2. The present public interest litigation has been filed with the grievance that private respondent nos.5 to 8 have encroached over the nala existing over Khasra No.229, Village Jangal Jogidher, Pargana Billhairi Tehsil Khatima, District Udham Singh Nagar. 3. Accordingly, prayer has been made for issuing direction to the respondents to take action against the illegal encroachments within a specified time frame. 4. Learned State Counsel has placed on record the instructions received from Sub-Divisional Magistrate, 1 UKHC010148432026 2026:UHC:7502-DB Khatima and wherein the fact relating to existence of nala over Khasra No.229 has been admitted. 5. Learned State Counsel states that the official respondents have already issued notices to the private respondents for removal of encroachments. He states that the proceedings in pursuance of the said notices would be concluded expeditiously. 6. In view of the aforesaid stand, the writ petition is disposed of with direction to the Sub-Divisional Magistrate, Khatima, Udham Singh Nagar (respondent no.3) to conclude the proceedings stated to have been initiated against the private respondents expeditiously in accordance with law. 7.
