Jha, APP …...... 02 /10.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 105/ 3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. The allegation against the petitioner is that they have fixed naked live electric wire in the river to catch fish. The deceased was cutting the bamboo and one of the bamboo fell in the river. The deceased went into the river and came in contact with the live electric wire and thereafter got electrocuted. The petitioner is in custody since 03.08.2025. 5. Considering the nature of allegation and the case is under section 105/3(5) of BNS and the chargesheet has already been submitted, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, 2026:JHHC:6226 2 Palamau at Daltonganj in connection with Nawa Jaipur PS Case No. 47 of 2024 corresponding to GR Case No. 1762 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand. 6.
