4. All these three petitions are moved under section 528 of BNSS, 2023, by the three applicants separately namely Tasleem S/o Saeed, Nadeem S/o Kallu and Tamrej S/o Ajeez , all are resident of Village Bukkanpur along with the

2026:UHC:7527 compounding applications with the affidavit of the victim Intasar @ Intzar for quashing of the proceeding of Criminal Case No. 1213 of 2025 (Now S.T. No. 04 of 2026), Criminal Case No. 490 of 2023 (Now S.T. No. 38 of 2023) and Criminal Case No. 29 of 2026 (Now S.T. No. 186 of 2026) arising out of one First Information Report dated 12.01.2023 bearing FIR No. 44 of 2023 P.S. Manglaur, District Haridwar, wherein, all these applicants by three different cognizance order were summoned to face the trial for the offences punishable under sections 353, 307, 504, 506 and 34 of IPC. 5. It is submitted by the learned counsel for the parties that for the small issue the dispute arise and all the applicants and the respondent/ complainant belongs to the same village Bukkanpur of P.S. Manglaur, District Haridwar and now they have resolved their dispute and their relations are very cordial and they want to close this proceeding. 6. All the applicants and the complainant join the proceeding through V.C. and are identified by their respective counsel. The complainant submits that he has settled the dispute and want to close the proceeding. 7. As per the record all the injuries are simple in nature and some of the penal provisions are though not compoundable but prima-facie from the contents of the FIR the dispute relates to a petty matter and, therefore, this court is of the view that continuation of the proceeding is completely a futile exercise particularly when the respondent/complainant himself do not want to proceed with these trials. 8.
Learned A.G.A. submits that the offences punishable under sections 353 and 307 of IPC though are not compoundable but taking into
consideration the nature of allegations and injuries with the leave of the court these two penal prvisions can also be compounded.
9. After hearing the submission of learned counsel for the parties and taking into
consideration that the applicants and the respondent/complainant belongs to the same

2026:UHC:7527 village, they resolved their dispute and now their relations are very cordial and the complainant himself does not want to proceed with the trial, therefore, this court is of the view that the compounding applications as well as all the three Criminal Miscellaneous Applications preferred under section 528 of BNSS, 2023 are deserves to be allowed and the proceeding of all these three trials since continuation of these proceeding are completely a futile exercise and there are very remote chances of their conviction, in such view of the matter, all these petitions preferred under section 528 of BNSS, 2023 and all the three pending trials i.e. S.T. No. 04 of 2026, S.T. No. 38 of 2023 and S.T. No. 186 of 2026, which are arising out of only one single FIR dated 12.01.2023 bearing FIR No. 44 of 2023 P.S. Manglaur, District Haridwar, are hereby quashed.
