PROPRIETOR, BASDEOSINGH MUKHTYARSINGH SOGARWAL VS NAGPUR IMPROVEMENT TRUST, NAGPUR THR. CHAIRMAN AND OTHERS ) Office Notes, Office Memorandum of Coram, appearances, Court's orders or the directions, Court's or Judge's order and Registrar's orders. Mr. B.G.Kulkarni, Advocate for petitioner. Mr. G.A.Kunte, Advocate for respondents.
CORAM :
ANIL S. KILOR AND RAJNISH R. VYAS, JJ. DATE :
SEPTEMBER 21, 2026 1) In the present writ petition, the grievance of the petitioner is that, despite the fact that respondent No.1 floated a tender for providing 48 computer operators and 02 electricians, and though the petitioner participated in the said tender and was found to be L-1, no work order was issued in favour of the petitioner. 2) Further, it is the grievance of the petitioner that a fresh tender was issued on 11/10/2024, but even the said tender was not processed, which resulted in continuation of the services of the earlier contractor, though his period was over on 31/07/2024. Admittedly, the first tender, in which the petitioner was found to be L-1, was for a period of one year, and the second tender, published on 11/10/2024, was also for a period of one year; however, as neither of the two tenders was taken to its logical end, for more than two years, the earlier contractor continues to be engaged. 2 11-wp 6340.2024.odt 3) In the circumstances, it would be in the interest of justice to direct respondent No.1 to initiate the process for issuance of a fresh tender and complete the same within a stipulated period. Accordingly, we direct respondent Nos.1 to 3 to proceed in the matter, issue a fresh tender for the aforementioned work, and complete the tender process in accordance with the prevailing guidelines. 4) Liberty is granted to the petitioner to file a fresh petition, in case such occasion arises. 5) The petition is disposed of in above referred terms. No
order as to costs.
