Learned advocate for the petitioner submits that the petitioner was implicated in the present case on the alleged recovery of 105 bottles of Phensedyl. The petitioner is in custody since 02.08.2024 and charge sheet has already been submitted before the jurisdictional court. 2. Learned advocate for the State opposes the prayer for bail. 3. I have taken into account the quantum of seizure as well as the period of detention of the petitioner and without entering into the merit of case and only on the ground of detention, I am inclined to release the petitioner on bail. 4. Accordingly, the petitioner namely Sagar Ali @ Nayan be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, Second Court cum Judge, Special Court under NDPS Act at Berhampore, Murshibabad. If on bail, 2 the petitioner shall be physically present on each and every date of hearing before the learned Special Court and shall not leave the district of Murshidabad without prior permission of the trial court. 5. In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6. With the aforesaid observation, CRM (NDPS) 258 of 2026 is allowed. (Tirthankar Ghosh, J.)
