P.P. ---- 02/21.01.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Kairo P.S. Case No.19 of 2025, for offence registered under section 303(2), 317(2), 132 of BNS, 2023, sections 4/21 of Mines and Minerals (Development and Regulation) Act, 1957 and section 54 of Jharkhand Minor Minerals Concession Rules, 2004, pending in court of learned S.D.J.M., Lohardaga. 3. Learned counsel appearing for the petitioner submits that petitioner happens to be the owner of the tractor and the allegations have been made of illegally loading the sand on the vehicle. He further submits that two owners of the different tractors have been granted anticipatory bail by this Court in A.B.A. No.7019 of 2025 vide order dated 11.12.2025. He also submits that petitioner has got one criminal antecedent. -2- 4. Learned counsel appearing for the State opposes the prayer for bail and submits that illegally the sand was being lifted on the said vehicle. 5. Considering that the petitioner is the owner of the tractor and two owners of the different tractors have already been granted anticipatory bail as aforesaid and further criminal antecedent cannot be the sole criteria of either allowing and rejecting the anticipatory or regular bail, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Lohardaga in connection with Kairo P.S.
