Learned advocate appearing for the petitioner submits that the de facto complainant is aged 37 years and the petitioner is 39 years. Both of them were in a relationship. However, the allegations are that there was suppression of fact that the present petitioner was married, in spite of the same he entered into a relationship. Learned advocate appearing for the de facto complainant submits that the case is at the stage of supply of documents under Section 207 of the Code of Criminal 2 Procedure and in spite of the same, other accused being absent is delaying the process of commitment of the case. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim. I have taken into account the allegations made by the victim, although a case is made out, but I am of the view that further detention of the present petitioner is unwarranted having regard to the fact that the lady while in the relationship was able to understand the consequences of her act. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Debopriya Chatterjee @ Gulu shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Serampore. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Hooghly without prior permission of the learned Trial Court. In case there is violation of any condition, the court in seisin of the present case would be at liberty to cancel the bail of the petitioner without further reference to this Court. The application for bail, being CRM (M) 2420 of 2025, is, thus, disposed of. 3 All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
