It is stated that the petitioner, in this PIL who taken up a cause on behalf of the public relating to challenge the Rajasthan Minor Mineral Concession Rules, 2017 and notification, has expired. 2. Learned counsel for the petitioner submits that in view of demise of the petitioner, the present petition may be allowed to be withdrawn. However, the issue raised in this petition may be kept open. Having regard to the nature of the case, we are prima facie of the view that the present matter is not a fit case to be entertained as a Public Interest Litigation, as it essentially involves a challenge to the vires and validity of the provisions of the Rajasthan Minor Mineral Concession Rules, 2017. 4. Considering the demise of the petitioner, the present writ petition (PIL) is dismissed as having become abated and the same be consigned to record.
