Islam, learned counsel for the petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor, Assam for the respondent No.1. Also heard Mr. A. Mishra, learned counsel for the informant/respondent No.2. 2. The case of the petitioners is that they have been charge-sheeted in connection with Barpeta P.S Case No. 1115/2018, now which is pending in court of Ld. Chief Judicial Magistrate, Barpeta, Assam, which registered as P.R.C Case No. 210/2022. Thereafter, the Ld. Trial Court issued summon, which was not received by the petitioners earlier, because they were totally unknown about this case, later on able to received the fresh summons, but they could not appear before the Ld. Trial Court as they are showing as absconder in the Charge Sheet filed in this case. 3. Thereafter, the informant realized his mistake and compromised the case due to filing the case on misunderstanding. Accordingly, on 24/07/2025, the informant compromised the matter and executed a Deed of Compromise with the petitioner No. 1. So, the petitioners have filed this criminal petition to quash the proceeding of P.R.C Case No. 210/2022 now pending in the court of Ld. Chief Judicial Magistrate, Barpeta with all other relevant orders including Charge sheet. 4. It is submitted by the learned counsel for the respondent No.2 that the matter has already been compromised and the learned counsel for the petitioner prays that the petitioner shall appear before the learned Trial Court and file appropriate application in this regard and prays for protection till then. Accordingly, the present criminal petition is disposed of with the observation that the petitioner shall appear before the learned Trial Court on the next date fixed i.e., on 20.08.2026 and file appropriate application which shall considered as per law. 6. Until such date or till their appearance before the learned Trial Court, whichever is earlier, no coercive action shall be taken against the petitioner. 7.
