This bail application has been filed on behalf of Saurav Das @ Saurav Kumar who is in custody since 13.08.2025 in connection with Domchanch P.S. Case No. 67 of 2025 for the offence registered under Sections 64(1), 87, 89, 351(2) of the B.N.S., pending in the Court of learned C.J.M., Koderma, is pressed into motion. It is submitted by learned counsel for the petitioner that the petitioner is aged about 23 years, whereas the age of the victim girl is 21 years and both are adults. As per the FIR, it was a case of consensual physical relationship on a false promise of marriage in which the victim girl became pregnant. There is no material to show that any inducement was offered on the part of the petitioner or promise made. Learned counsel for the State has opposed the prayer for bail and submitted that it is a case of rape on a false promise of marriage. Both the parties appear to be adults and the case was lodged one year after the victim became pregnant and miscarriage was caused. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
