Mr. Narendra Bali, Advocate, for the petitioner. Mr. I.P. Kohli, Standing Counsel, for the State. (2) Petitioner is aggrieved by order dated 3.4.2024, passed by Additional Commissioner, Garhwal in Appeal No. 41 of 2023-24. It is alleged that respondent no. 6 has purchased 5370 square metre land, situate in Yamkeshwar Block of District Pauri, in contravention of Section 154 of U.P. Zamindari Abolition & Land Reforms Act and the land so purchased, was vested in the State by Collector’s order dated 5.7.2022, however, Additional Commissioner set aside the order passed by the Collector only on the ground that declaration qua the land, in question, was issued under Section 143 of Zamindari Abolition & Land Reforms Act. (3) Learned Counsel for the petitioner submits that petitioner has made a representation to Collector, Pauri, who may be directed to take decision thereupon. (4) Learned State Counsel, however, submits that petitioner does not have any locus standi in the matter, as he claims to UKHC010149782026 2026:UHC:7654 have purchased a piece of land next to the land belonging to respondent no. 6; no representation can be made against a judicial order and if petitioner is aggrieved and he has legal capacity to maintain an appeal/revision, then he should have approached higher forum, available under law. (5) Learned Counsel for the petitioner submits that Collector be directed to take decision on petitioner’s representation. (6) Such direction cannot be issued as there is judicial order, which is coming in the way and Collector cannot take any decision contrary to the order passed by Additional Commissioner. Writ petition is, however, disposed of with liberty to petitioner to approach the appropriate forum, challenging the order passed by Additional Commissioner.
