Heard learned counsel representing the petitioner and
learned counsel representing the respondents.

In this writ petition, the petitioner is aggrieved by the
order as contained in Memo No.138 dated 09.05.2006 (Annexure-7 to the writ petition), whereby the petitioner was removed from the post of “Anganwadi Sewika”, of “Daaru-III, Anganwadi Centre”.

Though the petitioner was removed in the year 2006, but this writ petition is of the year 2023.
3.1. In the year 2008, this petitioner for the same relief

preferred a writ petition being W.P.(S) No.3678 of 2008, which got dismissed by a Coordinate Bench of this Court vide order 17.08.2017, for non-prosecution.
3.2. The petitioner filed a Civil Miscellaneous Petition being C.M.P. No.293 of 2021, for restoration of the aforesaid writ petition being W.P.(S) No.3678 of 2008, but the said Civil Misc. Petition was also dismissed vide order dated 23.12.2022.

Though the principle of Res judicata will not apply, but yet I am not inclined to entertain this writ petition, on the ground that in both the occasions, the writ petition and the Civil Misc. Petition preferred by the petitioner were dismissed.
4.1. Another ground for not exercising my discretionary jurisdiction is that the petitioner was removed wayback in the year
2006. Further, as per the counter affidavit, earlier vide Memo No.343 dated 21.11.2005, the Anganwadi Centre of Darudih, was attached to Anganwadi Centre, Daru-II, and the petitioner had given charge to Smt. Pratima Sinha, “Anganwadi Sewika”, on 30.11.2005.

Thus, I am not inclined to exercise my extraordinary jurisdiction under Article 226 of the Constitution of India.

Accordingly, this writ petition stands dismissed.
