GP FOR SOCIAL WELFARE 3 The Court made the following order: The present Writ Petition is filed questioning the action of Respondents in not releasing the financial assistance to the petitioner’s daughter, who submitted Application I.D.No.OV2018120742, under the ‘YSR Videshi Vidyadharana’ Overseas Scholarship Scheme, as illegal and arbitrary. 2. It is the specific case of the petitioner that his daughter, by name Sruthi Mendu, is pursuing her 4th year MBBS at Gannan Medical University, China. As his daughter obtained 95% marks in SSC and 96.7% in BIPC, she is entitled for an Overseas scholarship under the YSR Videshi Vidyadharana Scheme. His daughter submitted an application under the said scheme vide Application I.D.No.OV2018120742. The petitioner submits that he paid the entire course fee for his daughter’s MBBS course at Gannan Medical University, China, up to the 3rd year by obtaining loans from private finance companies. However, due to the financial losses suffered by him, he is presently unable to meet the expenses towards her course fee. The petitioner is required to pay the course fee, while the State Government has also not released the scholarship amount to which his daughter is entitled. 3. The petitioner further submits that a girl by name Golla Humani, who applied under the YSR Videshi Vidyadharana Scheme and is, studying at the same university along with his daughter, received the scholarship amount in her account on 31.03.2022, and a receipt evidencing the same has been filed along with the writ petition. 4 4. It is submitted that, unless the Government releases the scholarship amount at the earliest, his daughter will suffer irreparable loss and hardship, as Gannan Medical University is compelling her to pay the course fee, failing which she would be required to leave the university. If the scholarship amount is not released, his daughter may be compelled to discontinue the course and return to India, in which event all the efforts made by her during the last three years would be rendered futile. His daughter is in dire need of the course fee, as she has already completed three years of her studies. At this stage, if she is compelled to discontinue her course, she would suffer serious prejudice to her career. Though the petitioner is aware that the Government may not be in a position to release the entire amount at one time, at least part payments could have been made by now. However, no amount has been released till date. 5. The petitioner submits that his daughter is entitled to the benefit of the said scheme and, when such a scheme is in force, denial of the benefit thereof is arbitrary and illegal. Hence, the present Writ Petition is filed. 6. The learned Government Pleader appearing for the 4th respondent submits that the application of the petitioner would be considered and the amount would be sanctioned, subject to the petitioner’s daughter fulfilling the conditions prescribed for the release of the said amount. 7. As there is no dispute with regard to the consideration of the petitioner’s daughter’s application, the Writ Petition is disposed of, directing 5 the respondents to consider the application of the petitioner’s daughter bearing Application I.D. No. OV2018120742 and release the eligible scholarship/financial assistance amount, in accordance with the applicable guidelines of the “YSR Videshi Vidyadharana” Overseas Scholarship Scheme, subject to her fulfilling the conditions prescribed under the said scheme. The said exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
